Speak Out: Healthcare Mandate Upheld

Anyone who does not have it by 2014 will pay a penalty on their 2015 taxes.

In a 5-4 decision, the U.S. Supreme Court upheld the healthcare mandate requiring most people to have health insurance by 2014, CBS reports.

The upheld provisions include the individual mandate a provision allowing children to stay on their parents' healthcare until they're 26.

A contributor to the Supreme Court liveblog wrote, "The bottom line: the entire ACA is upheld, with the exception that the federal government's power to terminate states' Medicaid funds is narrowly read."

Who voted for what:

Pro: Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor, Elena Kagan and swing-vote Chief Justice John Roberts.

Dissent: Justices Scalia, Kennedy, Thomas and Alito.

Goo job Supreme Court. My college daughter with a pre-existing medical condition can stay on our policy until she's 26, and then be able to get coverage on her own. Let's stop arguing about this and get on with implementation Georgia!!!
HRoberts June 28, 2012 at 04:27 PM
It should have been insurance company reform NOT healthcare reform. Why don't the people in support of this live in Canada for a few years and then decide!!
Frank Jones June 28, 2012 at 06:46 PM
@James...This isn't a new tax, it's social responsibility! Have you ever wondered why your healthcare costs so much? A significant part of the cost is that you, I, and the rest of the insured people foot the bill for all those who aren't insured! In this country, we have a law that requires hospitals to treat individual in an emergency without verifying they have insurance. The tab for a single patient can be hundreds of thousands and happens thousands of time every single day. And if the person cannot pay...guess what, you and I pay for them. @HRoberts...based upon my research, the rest of the industrialized world has socialized medicine in one for or another AND all of their citizens receive treatment as quick or quick than we do, for less cost. IMO...It is the government's role to ensure that we as a nation be socially responsible for the betterment of the country. For instance, government require immunizations before attending school. Government requires car insurance to drive. Government denies children the right to work before age 14, and then only for limited hours/day. For all you "anti-government" people, without government we'd be in big, big trouble.
Greg Cantrell June 28, 2012 at 07:02 PM
Just as James has already stated, it is a tax, even though obama and his white house staff have stated emphatically it was not a tax. Tax issues require a straight up vote in the senate...no filibuster. Time to get this law over turned after the elections in November! Krista, there are some good provisions in the law as you pointed out but it over extends government powers. The vast majority of people agree the government is corrupt and unable to accomplish most task..do you really want them deciding if you live or die?
james June 28, 2012 at 07:04 PM
Frank, you are part of the problem. Keep on seeing things that way and the govt will eventually own you, wait they do own you already, but not me. The only responsibility I have is to myself and my minor children. You and I will never see things the same, so Im not going to argue with you.
Frank Jones June 28, 2012 at 07:15 PM
@Greg...Government is not corrupt, but there are many elected politicians who are. As to your question as to whether "you really them (the Gov't) deciding if you live or die?", that's a stupid question! Our gov't decides every day if we live or die! Car safety standards are dictated by the Gov't. Drug safety is dictated by the Gov't. The Gov't could press the button any day to kill every American via Russian retaliation. And as the law is written doesn't give the Gov't the power to withhold medical treatments...That power remains with the person, his medical advisors, and the insurance companies! Lastly, a sizable portion of American citizens receive government healthcare via the VA, medicare, medicaid, Gov't employee health plans, and more...Last I checked, they aren't killing Americans just for the sake of killing Americans.
Frank Jones June 28, 2012 at 07:18 PM
Oh, and by the way, if you are sick with a terminal illness, the Gov't says it's against the law to end your life early or to receive assistance in ending your life. They're denying you the freedom to control your God given rights. Where's your outrage?
Roy Weatherby June 28, 2012 at 09:03 PM
Obama and the Congress pass a law that is both unwanted by the people and unconstitutional. The supreme court upholds this draconian law. Think we might be in trouble as a nation?
Jim Beam June 28, 2012 at 11:56 PM
Frank, that may be your opinion (what you envision to be govt's role), but nowhere in the Constitution is there anything about people being 'socially responsible'. ObamaCare does nothing but continue the reality that society's leeches (the half of Americans who pay no income tax whatsoever) will continue to drain the resources from the half of America that pays taxes. At the end of the day, THAT is the most-important part of the Democratic platform that you support: To take from the producers and give to those who contribute nothing to society. For all your Utopian idealism about 'social responsibility', what is the half of America that lives off the backs of taxpayers doing for their part? Besides collecting welfare checks and using foodstamps to buy cigarettes? For all you Big Gov't Lovers....without us private citizen taxpayers, your Utopian plans of unicorns and rainbows don't exist.
Greg Cantrell June 29, 2012 at 12:07 AM
Well, you've got me there Frank..our government has done a good job at not provoking the Russians into a nuclear holocaust so far.
Frank Jones June 29, 2012 at 03:01 AM
Steely Dan...in your opinion and that of the Republican party, the poor, working poor and senior citizens are leeches since they party no income tax. However, senior citizens have akeasy paid their taxes and are living off of their retirements or working parttime at Walmart to supplement their retirement. The working poor simply don't make enough to pay income tax and yet the pay social security, medicare and sales tax. The true poor, your worst leeches may have other issues that prevent them from working. Lastly, the are many military personnel, firemen, police officers, teachers, blue collar laborers, secretaries and others that work hard and benefit society yet pay no taxes because they just don't make enough to part taxes. Shame on you for calling people"beneath"you leeches.
Jim Beam June 29, 2012 at 01:54 PM
Frank, I know it's an Obama tactic but don't put words into my mouth. I never said a word about seniors, who've likely paid into the very system they're now withdrawing from via Soc. Security and Medicare. Likewise, firemen, cops, teachers, etc are all working and paying taxes. These people are making well above the minimum income level that I'm referring to and paying their taxes accordingly. And the military is completely above reproach and deserves all the VA benefits and healthcare that they risked their lives for my freedom for. These folks deserve that $$ upon retirement age- it is THEIR money. This is a concept you entitled, Utopian liberals cannot get thru your thick skulls - IT IS OUR MONEY NOT YOURS. I'm disappointed in you, Frank. I thought you were at least slightly rational but your post above is filled with claptrap. I do NOT want to subsidize the healthcare of illegal immigrants and those who refuse to find work nor those who are already getting massive public assistance via welfare and food stamps. When is it enough for you guilt-ridden libs? Why do you hate the producers of America so much? Keep your silly 60's-era idealism out of my wallet!! LBJ's Great Society was a Great Failure and ObamaCare will be too.
Frank Jones June 29, 2012 at 04:26 PM
Steely Dan...I didn't put words in your mouth, YOU DID when you professed that half of American are leeches since they pay no income taxes. As I pointed out, seniors citizens and low income families make up a sizable portion of that 50%. These individuals and families have either already worked and contributed to our society (The Seniors) or are currently working but simply not making enough to pay taxes (Seniors and the Working Poor). A family of 4 with roughly $26,500 in income would have $0 income tax liability but would still pay FICA and sales taxes. You consider these people "LEECHES". Cherokee County School District has hundreds of full-time staffers making less than $26,500 including teachers, school nurses, bus drivers, food service workers, special ed parapros, custodial personnel, and secretaries. I guess these employed people are LEECHES. Illegal immigrants may not pay income taxes, but if their employee is obeying the law, the illegal immigrants are paying FICA yet receiving no benefits. Before you use a broad brush and start calling people LEECHES, you should at least understand the actual tax code and demographics. There are "leeches" but it is closer to 0% than 50%!
Jim Beam July 02, 2012 at 07:39 PM
Frank, you're a misinformed idealist and I wish you and your ilk would get your hands of my pocketbook - I'm tired of having to subsidize your numerous failed liberal ideologies that aren't remotely outlined in the Constitution. Take your ObamaCare and shove it into the failed hellhole that Great Society ended up. Fact: Nearly HALF of Americans aren't paying income tax. http://blog.heritage.org/2012/02/19/chart-of-the-week-nearly-half-of-all-americans-dont-pay-income-taxes/ http://nation.foxnews.com/taxes/2012/02/22/percentage-americans-who-pay-no-income-tax-hits-495 http://www.washingtonpost.com/blogs/ezra-klein/post/why-do-half-of-all-americans-pay-no-federal-income-taxes/2011/07/11/gIQA8olBuI_blog.html Of course, the real truth is that you and your liberal buddies love keeping millions of Americans in poverty so that they'll keep voting more tax&spend Democrats into power...who'll continue to pass legislation that keeps the poor in poverty. And the loser cycle keeps repeating while you libs wring your hands and beg for increased taxation to throw at another silly non-solution to the problem.
Frank Jones July 03, 2012 at 04:01 AM
Steely, I am better informed than you as I understand the demographics of those that pay taxes, those that pay employment taxes and who don't. Unfortunately, you are getting all of your information from Fox and other biased conservative organizations and blogs. The fact of the matter is that the great society has been a success, that taxes ARE at the lowest burden in over 60 years, that Obamacare is Romneycare. Lastly, the only"problem"with Obamacare is the mandate which is to punish those who don't want to carry insurance and who in turn are more likely than not to not pay their bill and force us to pay it for them. This has nothing to do with keeping the poor poor or taxing the wealthy. It's about improving access to healthcare, improving the health of the population, which will/can then save money going forward. As to you calling 50% of the population LEECHES, my reply shows you are flat wrong in referring to most of them as LEECHES. You're disgusting!
Jim Beam July 03, 2012 at 05:32 AM
Frank, your reply is liberal claptrap, as is your desire to get the 50% paying income tax to help subsidize your failed liberal ideas. You are not better informed. You are just heavily indoctrinated into the belief system that Govt Is Great. RomneyCare sucks, so I'm not sure why you're hanging your hat on that. Every single thing the gummint touches turns to crap. Great Society did nothing but keep millions of poor people poor. Figures you'd think the failed idea of mass housing complexes a successful one, given all evidence to the contrary. LBJ sucked and so does Obama.
Frank Jones July 04, 2012 at 03:37 AM
Steely, once again, you show your stupidity and bias. There will always be wealthy. There will always be poor. There may or may not be a middle class. Under the policies of the early to mid 1900's, the middle class grew exponentially. Under the policies expoused by Reagan, the Bushes, and now the current Republicans, the middle class is shrinking and without a strong, vibrant, and financially secure middle class, our country is destined to suffer and decline. You claim govt does nothing right and is crap. To follow your logic, the military it's crap, so is the FBI, SEC, EPA, FDA, DOT, NASA, CIA...shall I continue? Why don't you just admit that you erred when you claimed that 50% of Americans, which include retirees, some teachers, firefighters, police, hard-working low-paid people are LEECHES? The modern Republican party is the of money and contempt for the have nots.
Jim Beam July 04, 2012 at 09:26 PM
Frank, your liberal mindset blinds you to the disastrous effects that unions have had on the private sector during the period of time you cite. But you're a left-winger who thinks he's entitled to the earned wealth of others. You don't care about personal property nor individual liberty but, apparently after several bong hits, have arrived at the utopian conclusion that the American taxpayer must subsidize your failed liberal ideals. What happens when the American taxpayer is tapped out from funding your 'social responsibility'? Are your liberal gov't thugs going to start seizing more personal property to finance the un-affordable? How'd the FBI & CIA fare in preventing 9/11? Shall we review the massive waste that doomed NASA? Ever waited in a DOT line in downtown ATL? The tens-of-thousands-of-pages of our tax code, thanks to your heroes at the IRS? The military's about the only govt'-funded group worth a crap. And that's mainly because they've got military people running the show behind the scenes rather than a bunch of foolish, tax&spend liberals. The modern Republican party certainly needs reform but the modern Democrat party is hopelessly broken and too tied to unions and fools for any hope of it becoming a viable option for America. Obama is the biggest, egotistical scumbag president in American history. He's so bad he manages to make Romney palatable. You and your ideas are both dangerous and delusional, Frank.
