Teen Should Not Have Been at Wheel

Because he suffered a severe brain injury, the unidentified teen will not be cited at this time, the spokesman for the Cherokee County Sheriff's Office said today.

The 14-year-old boy who was at the wheel of a Yamaha Rhino when a should not have been in the driver's seat, the spokesman for the said.

"Technically," Lt. Jay Baker said, "it is a misdemeanor to drive that type of vehicle on a public road. He was crossing the road from a private drive, not driving down the public road. Still illegal."

But because he suffered a severe brain injury, the unidentified teen will not be cited at this time.

"Although he is at fault," Baker said, "citing him with a traffic violation is trivial. He remains in critical condition" at Scottish Rite Children’s Hospital.

At 4 p.m. Wednesday, spokesman Tim Cavender said authorities responded to an accident at 2181 Lower Burris Road. When authorities arrived, the Yamaha was on its side.

"Sgt. Brandon Carr stated that the patient had head trauma and was in and out of consciousness," Cavender said Wednesday. "The male teenagers in the automobile, ages 17 and 19, refused treatment and were not transported."

Baker said the accident remains under investigation.

"We are not releasing the juvenile's name," he said.
